CHEEKY PEACH RENTALS

RENTAL AGREEMENT AND TERMS OF SERVICE

Effective Date: June 2026

By reserving, renting, receiving, possessing, or using any garment, accessory, or other item (“Rental Item”) from Catherine Jacobs LLC DBA Cheeky Peach Boutique (“Cheeky Peach,” “we,” “our,” or “us”), the customer (“Customer,” “you,” or “your”) agrees to be legally bound by this Rental Agreement and Terms of Service.

  1. OWNERSHIP OF RENTAL ITEMS

All Rental Items remain the sole property of Cheeky Peach Boutique LLC at all times.

The Customer acquires only a temporary right to use the Rental Item during the rental period. No ownership interest is transferred.

  1. ELIGIBILITY

Customers must be at least 18 years of age and possess a valid payment method.

By placing an order, the Customer represents that all information provided is accurate and complete.

  1. RESERVATIONS AND PAYMENT

Full rental payment is due at the time of booking unless otherwise stated.

A reservation is not considered confirmed until payment has been successfully processed.

Cheeky Peach reserves the right to refuse, cancel, or modify any reservation due to inventory availability, garment condition, suspected fraud, pricing errors, operational limitations, or other circumstances beyond our control.

In the event of cancellation by Cheeky Peach, the Customer’s sole remedy shall be a refund of amounts paid.

  1. RENTAL PERIOD

The rental period begins on the scheduled pickup date, delivery date, or possession date, whichever occurs first.

The rental period ends on the return date specified in the order confirmation.

Rental Items must be returned by the specified return deadline.

  1. CUSTOMER RESPONSIBILITY

The Customer assumes full responsibility for each Rental Item from the time possession is obtained until the item is physically received and accepted by Cheeky Peach.

The Customer bears all risk of loss, theft, destruction, damage, misdelivery, or failure to return.

  1. CONDITION OF ITEMS

All Rental Items are inspected prior to release.

Customers must inspect Rental Items immediately upon receipt.

Any claim regarding incorrect items, significant damage, or material defects must be reported within twenty-four (24) hours of receipt.

Failure to notify Cheeky Peach within twenty-four (24) hours constitutes acceptance of the Rental Item in its delivered condition.

  1. FIT, SIZE, AND STYLE DISCLAIMER

Sizing recommendations are provided as a courtesy only.

Cheeky Peach does not guarantee fit, comfort, appearance, suitability for any event, or customer satisfaction.

Differences in fit, personal preference, styling expectations, or event changes do not constitute grounds for refunds.

  1. PROHIBITED USES

Customers shall not:

• Alter any Rental Item • Hem, tailor, or permanently modify any Rental Item • Dye or bleach any Rental Item • Attempt repairs • Remove tags or identifying labels • Use fabric adhesives, iron-on products, or permanent fasteners • Sublease or transfer possession to another party

Unauthorized modifications may result in replacement charges.

  1. CLEANING POLICY

Routine professional cleaning is included in the rental fee.

Customers shall not wash, dry clean, steam, repair, spot-treat, or otherwise attempt to clean Rental Items.

Cheeky Peach reserves sole discretion to determine whether damage or contamination exceeds normal wear.

  1. DAMAGE

Normal wear is expected and included in the rental price.

Damage exceeding normal wear includes, but is not limited to:

• Tears • Rips • Burns • Permanent staining • Makeup damage requiring specialty treatment • Self-tanner damage • Wine damage • Pet damage • Smoke damage • Missing embellishments • Broken closures or zippers caused by misuse • Odor contamination • Unauthorized alterations

Customers agree to reimburse Cheeky Peach for all repair, restoration, specialty cleaning, or replacement expenses.

  1. CANCELLATION POLICY

If a rental agreement is cancelled by the customer more than 14 days before rental date they will receive and full refund. If cancellation by the customer occurs 7-13 days before rental, the customer will receive a store credit only to be used within a calendar year from date of cancellation. Any cancellation by the customer less than 7 days before the rental date will be non-refundable.

  1. LOSS, THEFT, OR DESTRUCTION

If a Rental Item is lost, stolen, destroyed, abandoned, or otherwise not returned, the Customer shall be responsible for the item’s full retail replacement value.

Replacement value shall be determined solely by Cheeky Peach based upon current replacement cost, retail value, sourcing cost, shipping expense, and administrative expense.

  1. LATE RETURNS

Time is of the essence.

Because Rental Items are frequently reserved by subsequent customers, late returns cause significant business damages.

The following late fees shall apply:

A $10 per day late fee will be charged to the authorized credit card on file. 

More than 14 days late: Item may be deemed lost and replacement charges may apply.

Late fees are cumulative and do not limit Cheeky Peach’s right to recover additional damages.

  1. AUTHORIZATION TO CHARGE PAYMENT METHOD

The Customer expressly authorizes Cheeky Peach to charge the payment method on file for:

• Late fees • Repair costs • Specialty cleaning costs • Replacement costs • Collection expenses • Shipping costs • Administrative fees associated with damage claims

This authorization survives the completion of the rental transaction.

  1. SECURITY AUTHORIZATION

Cheeky Peach reserves the right to place a temporary authorization hold on any payment method provided.

The amount of any authorization hold shall be determined solely by Cheeky Peach.

  1. NO GUARANTEE OF EVENT SUCCESS

Cheeky Peach is not responsible for:

• Missed events • Wedding disruptions • Formal event disruptions • Weather conditions • Transportation issues • Shipping delays • Personal dissatisfaction • Venue requirements • Third-party carrier delays

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Cheeky Peach shall not be liable for indirect, incidental, consequential, punitive, special, or exemplary damages.

Cheeky Peach’s total liability shall never exceed the rental fee paid for the specific Rental Item.

  1. INDEMNIFICATION

The Customer agrees to defend, indemnify, and hold harmless Cheeky Peach Boutique, its owners, employees, agents, and affiliates from any claim, loss, liability, damage, cost, or expense arising from the Customer’s use, possession, transportation, or handling of a Rental Item.

  1. COLLECTION COSTS

The Customer agrees to pay all reasonable costs incurred in collecting unpaid balances, including collection agency fees, court costs, filing fees, and reasonable attorney’s fees where permitted by law.

  1. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia.

Any dispute shall be resolved exclusively in the courts located in Clarke County, Georgia.

  1. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions, representations, and understandings.

  1. ELECTRONIC ACCEPTANCE

By completing checkout, placing an order, signing electronically, clicking an acceptance box, or otherwise obtaining possession of a Rental Item, the Customer acknowledges that they have read, understood, and agreed to this Rental Agreement and Terms of Service.
